Article (1) Definitions

In application of the provisions hereof, the following words and phrases shall have the meanings assigned to each of them, unless the context requires otherwise:
Authority: Telecommunications and Digital Government Regulatory Authority.
Chairman: Chairman of the Authority’s Board of Directors.
Decree-Law: Federal Decree-Law No. (46) of 2021, on Electronic Transactions and Trust Services.
Trust Services: The Electronic Services specified under Clause (1) of Article (17) of the Decree-Law, for which the Trust Service Provider is licensed to provide in accordance with the Licence issued thereto.
Accredited Trust Services: The Electronic Services specified under Clause (2) of Article (17) of the Decree-Law, for which the Accredited Trust Service Provider is licensed to provide in accordance with the Licence issued thereto.
Trust Service Provider: The party licensed by the Authority in accordance with the provisions of the Decree-Law and its Executive Regulation to provide one or more Trust Services.
Accredited Trust Service Provider: A Trust Service Provider granted the status of being accredited by the Authority to provide Trust Services and Accredited Trust Services according to the status granted thereto.
Licensee: The legal person licensed by the Authority in accordance with the provisions of the Decree-Law and its Executive Regulation.
License: The authorisation issued pursuant to the provisions of the Decree-Law and its Executive Regulation, which allows the Licensee to carry out any of the Trust Services or Accredited Trust Services.
 

Article (2) Service Fees

1. The Authority shall collect the fees shown in the Tables attached to this Resolution in consideration of the services provided thereby.
2. The fees collected by the Authority for any of the services specified in the Tables attached to this Resolution are non-refundable, regardless of the outcome of the submitted application.
3. The Authority shall apply the mechanism for calculating fees for adding a new service to the current licence based on the principle of proportionality for the remaining period of the licence, provided that the fee for licensing the added service shall not be less than (1,000) one thousand AED.
 

Article (3) Fee Amendment

The Cabinet shall have the competence to make any amendments to the fees mentioned in this Resolution, whether by addition, deletion or modification.

Article (4) Fee Collection

The Authority shall collect the fees mentioned in this Resolution through the means determined by the Ministry of Finance.

Article (5) Executive Resolutions

The Chairman shall issue the Resolutions necessary for implementation of the provisions of this Resolution.

Article (6) Repeals

1. Cabinet Resolution No. (8) of 2009 Concerning the Fees Payable on Transactions of Electronic Certification Service Providers shall be repealed.
2. Any provision that violates or contradicts the provisions of this Resolution shall be repealed.
 

Article (7) Publication and Enforcement

This Resolution shall be published in the Official Gazette and shall enter into force as of the day following its publication date.
