Article (1) Definitions

In application of the provisions herein, the following words and expressions shall have the meanings ascribed thereto, unless the context requires otherwise:
State: United Arab Emirates.
Authority: Federal Authority Identity, Citizenship, Customs, and Ports Security.
Chairman: Chairman of the Authority.
Services: Transactions carried out by the Authority to meet the needs of service recipients.
System: The electronic system through which the Authority’s services shall be provided.
System Users: All government agencies, establishments and individuals who obtain the services provided through the System.
Service Recipient: Relevant auditors or their representatives from all government agencies, establishments and individuals.
Establishment: Any institution or company licensed under the applicable legislation to engage in any economic, service, professional, craft, agricultural, or other activity.
Financial Guarantee: The amounts of money to be submitted in accordance with the conditions referred to in this Resolution.
Identity Card: A card issued in accordance with the provisions of the law with a unified number, and it shall include the data necessary to determine the identity of its holder and shall contain visible and invisible data that shall be stored electronically within the electronic Sharia that it contains.
Certification Portal: A portal that enables the beneficiaries of the service to identify and verify the identity of their customers electronically.
Electronic Link Services: A platform that allows service beneficiaries to provide and verify personal data.
Digital Certification and Electronic Link Transaction: A request submitted by the beneficiaries of the service to obtain one of the services of the digital certification portal and electronic link services, which results in a successful response thereto from the ICP
 

Article (2) Fees of Services

1. In consideration of the services provided by the Authority as shown in table no. (1), attached herein, the fees assigned thereto shall be collected.
2. The fees charged for issuing the services as shown in table no. (1) attached herein shall be refunded, in the case that the application submitted in this regard is incomplete.
 

Article (3) Digital Certification Portal and Electronic Link Services Fees

1. For the services of the digital certification and electronic link portal provided by the Authority, as shown in table no. (2) attached herein, the fees assigned thereto shall be collected.
2. A one-time subscription fee of (AED 25,000) twenty-five thousand dirhams shall be collected or upon reactivation of the closed account in return for obtaining the services of the digital certification portal and the electronic link services.
3. The federal or local government entity shall be exempted from paying the fees set forth in Clause (1) of this Article, and this shall not include companies owned by these entities or which are co-owners of them.
4. The Chairman shall issue the controls for the services of the digital certification portal and the electronic link.
 

Article (4) Subscription to the System

1. System Users shall subscribe thereto in accordance with the requirements and controls issued by Chairman Resolution, and pay the fee prescribed in Table No. (1) attached herein in return for obtaining the service.
2. The Service Recipients shall bear the cost of the service provided to them and the material consideration referred to in Clause (3) of this Article.
3. The Chairman, in coordination with the Minister of Finance, shall issue a resolution determining the material remuneration that System Users receive in return for the services they provide to the Service Recipient.
 

Article (5) Financial Guarantees

1. In exchange for the following transactions, the financial guarantees assigned thereto in the table below shall be collected:

2. The Chairman shall specify the conditions and controls for fulfilling the financial guarantees referred to in Clause (1) of this Article and the cases of exemption from them.
3. The Chairman may reduce or order instalment of the amount of the value of the financial guarantees referred to in Clause (1) of this Article.
 

 

Article (6) Refund or Execution of the Financial Guarantee Amount

1. The amount of the financial guarantee referred to in Article (5) herein shall be refunded according to an application submitted by the person concerned in the event that the person submitting it adheres to the purpose for which the guarantee was met.
2. The financial guarantee referred to in Article (5) herein shall be fully executed in any of the following two cases:
    a. Violation of the legislation regulating the entry and residence of foreigners in the State.
    b. The failure of the provider of the financial guarantee to apply for its refund within (5) five years as of the date of its entitlement, and after the lapse of this period, it becomes public money to be supplied to the State treasury.
3. The Chairman or his Authorised Representative may be exempted from implementing the financial guarantee referred to in Article (5) of this resolution or return it after execution.
 

Article (7) Exemption from Fees and Financial Guarantees

1. Citizens of countries included in the visa exemption system in accordance with the legislation in force in this regard shall not be exempted from the entry visa extension fee referred to in Table No. (1) attached herein.
2. Courtesy entry visas, wanted persons, and special visas shall be exempted from the fees and financial guarantees stipulated in accordance with the provisions herein, in the case that an invitation is sent by one of the ministries, departments, and federal and local governmental public bodies to persons abroad.
3. The following categories and cases shall be exempted from the fees and financial guarantees mentioned herein:
    a. Subject to the Social Security Law.
    b. Persons with disabilities "determination" and autism.
    c. Families of martyrs according to the categories determined by the Chairman.
    d. The deceased.
    e. The category of diplomatic missions and consuls in embassies, consulates, and the like within the State.
    f. In the case of a material error due to a reason attributable to the ICP when issuing identity cards or passports of citizens.
    g. When replacing the identity card in order to add the signature and fingerprint for those over fifteen (15) years of age, and the same remaining validity as the previous card is granted.
    h. Fishing boat establishments, where they are exempted from fees and guarantees for issuing entry and residence visas and establishment cards.
    i. Sailors and crews of tourist and pleasure craft.
    j. The escorts of foreigners coming to the State for tourism (children of tourists) who are under the age of (18) eighteen years, who shall be exempted from the fees and guarantees of an entry visa for the visit for the purpose of tourism.
    k. The companions of citizens of the Gulf Cooperation Council (GCC) who are on their personal guarantee, based on a chairman resolution, where they are exempted from fees and guarantees for the entry visa for the visit, provided that they shall accompany their guarantor.
    l. Persons who are deported or expelled by order, administrative resolution, or court ruling.
    m. Those who obtained a transit visa for single entry for the first (48) hours of airports, and those who obtained an emergency entry visa.
4. Cabinet resolutions regarding exemption or reduction of fees for services provided by the ICP issued prior to the implementation of the provisions herein shall continue unless a resolution is issued by the Cabinet to cancel them.

Article (8) Collection of Fees and Guarantees

1. The Authority shall collect the fines mentioned herein in accordance with the collection mechanism after coordination with the Minister of Finance in this regard.
2. The collected fines shall be deposited in the account of the unified State treasury, and they shall be monitored in accordance with the criteria set by the Ministry of Finance for this purpose.
 

Article (9) Advertising Revenue

The Authority may collect financial returns in return for publishing advertisements and means of advertising through the existing devices and mechanisms, and such returns shall be issued by a resolution of the Chairman after coordination with the Minister of Finance.

Article (10) Final Provisions

1. The Authority, or any entity that is authorised, may contract with public and private institutions and companies to provide any of the services.
2. For the purposes of collecting the fees stipulated in Article (2) herein, part of a day shall be considered a full day, part of a month shall be considered a full month, and part of a year shall be considered a full year.
 

Article (11) Fee Amendment

The Council of Ministers shall have the authority to make any amendments to the fees mentioned herein, whether by addition, deletion or amendment.

Article (12) Repeals

With the exception of Cabinet Resolution No. (10) of 2010 regarding the departure fee through the State sea, air and land ports, the following Cabinet resolutions shall be repealed, as well as any provision that contradicts or contravenes this resolution:
1. Cabinet Resolution No. (25) of 2011 Concerning fees charged for services provided by the Emirates Identity Authority;
2. Cabinet Resolution No. (22) of 2014 regulating and developing the services of the Citizenship, Residency Affairs and Ports Sector at the Federal Authority Identity, Citizenship, Customs, and Ports Security, and any amendments thereof;
3. Cabinet Resolution No. (62) of 2017 about the introduction of fees for digital certification portal services and electronic link services provided by the Federal Authority Identity, Citizenship, Customs, and Ports Security; and
4. Cabinet Resolution No. (23) of 2020 regarding the return of banking and financial guarantees submitted to the Federal Authority Identity, Citizenship, Customs, and Ports Security.
 

Article (13) Publication and Enforcement

This Resolution shall be published in the Official Gazette and shall come into force as of 03/10/2022.
