Article (1) Definitions
In application of the provisions of this Resolution, the following words and phrases shall have the meanings assigned to each of them, unless the context requires otherwise:
Authority: Federal Authority for Nuclear Regulation (FANR).
Board: Authority’s Board of Directors.
Facility: Any place where radioactive materials are produced, treated, used, handled, stored or disposed of or where radiation generators are installed on a scale where considerations for protection and safety are required, including nuclear facilities, irradiation installations, mining and raw material treatment facilities, and waste disposal facilities.
Naturally Occurring Radioactive Material: A material that does not contain significant amounts of radionuclides as opposed to naturally occurring radionuclides.
Disposal Facility: A facility specifically designed and constructed for the disposal of naturally occurring radioactive waste.
Naturally Occurring Radioactive Waste Treatment Facility: A facility specifically designed and constructed for the handling and treatment of naturally occurring radioactive material.
License: The approval issued by FANR that authorises the licensee to carry out one or more specific regulated activities related to a facility or activity, or any other approval granted by FANR to the applicant to carry out the tasks of determining the location of a nuclear facility, designing it, constructing it, bringing it into service, operating it, decommissioning it, or carrying out any activity related to the disposal of spent fuel or radioactive waste.
Construction: The process of manufacturing and assembling facility components, carrying out civil and building construction works, installing components and equipment and conducting relevant tests.
Operation: Carrying out all activities to achieve the purpose for which a FANR licensed facility was constructed.
Decommissioning: Administrative and technical procedures taken to remove some or all of the regulatory controls imposed on a facility (except for a radioactive waste repository or designated nuclear facilities used for the disposal of radioactive mining waste and treatment thereof, which are closed and not decommissioned).
Closure: Administrative and technical procedures taken at a radioactive waste repository at the end of its operational life, such as covering the deposited waste (in the case of a near-surface repository) or backfilling and/or sealing (in the case of a geological repository and the passages leading to it); and the termination and completion of activities in any buildings related to a radioactive waste repository.
Storage: Maintaining radioactive sources, spent fuel, or radioactive waste in a facility that ensures their containment for the purpose of recovery.
Article (2) Service Fee
In consideration of the services provided by FANR as shown in the Table attached to this Resolution, the fees assigned to each of them shall be collected.
Article (3) Fee Amendments
The Cabinet shall have the competence to make any amendments to the fees mentioned in this Resolution, whether by addition, deletion or amendment.
Article (4) Fee Collection
Fees stipulated in this Resolution shall be collected through the methods decided by the Ministry of Finance.
Article (5) Executive Resolutions
The Board shall, in coordination with the Ministry of Finance, issue the resolutions and procedures necessary to implement the provisions of this Resolution.
Article (6) Publication and Entry into Force
This Resolution shall be published in the Official Gazette and shall enter into force as of the day following the date of its publication.
