Article(1) Definitions
The following terms and expressions shall have the meanings assigned to them unless otherwise requires:
The Minister: the Minister of Agriculture and Fisheries.
Competent Authority: The Department of Agricultural Quarantine.
Quarantine: Each building or shed allocated for examining or processing of the agricultural consignments according to the provisions of this law.
Body: Each company, trade house, university, governmental institution, diplomatic corps, or any other body dealing with plant production either through importation or exportation.
Plant: any sort of plant or its part whether was live or dead, its shape or condition whether straw, branches, tubers, corms, cuttings, wooden veins, rhizomes, roots, roots leaves, fruits, seeds and seedlings.
Plant products: products of plant origin which were prepared to keep up with their nature.
Contaminants: The seeds of plants or harmful weeds or part of them whether alive or dead.
Agricultural consignment: Imported or exported plants, their parts or plant productions submit to the provisions of this law.
Infection: Appearance of pests or diseased symptoms or other symptoms on plants or plant products.
Article (2)
All plants and agricultural products shall submit to the regulations of the agricultural quarantine,
And they shall not be allowed to enter the country if suspected infecting with pests or any of the plant diseases as shown in the table number ( 1 ) attached to this law, and the council of ministers may issue a resolution in accordance with the submission of the minister of agriculture and fisheries to amend the table through adding or omitting the name of any of the pests or plant diseases .
The Minister may instruct to allow these infected plants or their products to enter upon the request of the owner if found easy to get rid of all pests or their different stages according to the way determined by the ministry at his expense.
Article (3)
Plants and plant products are not permitted to enter the country unless being sterilized at the expense of the owner before being released.
Soil and organic fertilizer are prohibited to inter with the agricultural consignments unless being authorized by the competent authority.
Article (4)
The minister may issue ministerial decree to permit entering some species of infected plants and agricultural products if proved not dangerous or will economically affect the local crops.
Article (5)
Bodies are not permitted to import living insects, bacteria, virus, fungi, or agricultural materials either infected or suspected to be infected by any of the plant diseases for scientific research or experiments unless being obtained prior permission from the competent authority.
Article (6)
Agricultural consignments are not permitted to enter the country unless being accompanied with health certificate issued by the competent authorities in the exporting country and attested by from the UAE embassy in the exporting country if available that it has been found free of contaminants and has been sterilized.
Article (7)
The competent authority shall prompt to give a certificate which prove that the exported agricultural consignment was found after inspection free of pests, diseases and contaminants, and corresponding the agricultural Quarantine systems in the imported country, and the competent authority shall have the right to undertake the necessary treatment of the agricultural consignment at the expense of its owner if suspected infected by diseases or pests.
Article (8)
All plants, and plant products either was imported or exported to inspection measuring by the competent authority, and the authority shall have the right to reject the imported agricultural consignment if found not corresponding with the systems and regulations of the agricultural Quarantine and the provisions of this law, and return it back at the expense of the owner or to be wearing out according to conditions.
Article (9)
Transit plants and plant products are subject to agricultural Quarantine system, and it shouldn't stay in the agricultural Quarantine more than seven days.
Transit consignments of plants and plant production should not be enter the country if proved infected.
Article (10)
The competent authority shall setup the formalities and the regulations to ensure the application of the provisions of agricultural Quarantine system in order to restrict spreading of pests and plant diseases on growing crops, jungle, nurseries and gardens in accordance with the rules decided by the Minister.
Article (11)
Without any prejudice to any punishment provided for in any punitive law, any person contravening the provisions of this law shall be sentenced upon conviction to a term of imprisonment not exceeding three months and a fine not exceeding Dirham five thousand or both penalties as well as confiscating all plants, their products and the agricultural consignment in question.
Article (12)
Employees of agricultural Quarantine authorized by the Minister to pursue the implementation of the provisions of this law and the executive regulations pertaining thereto shall be deemed to be as
Judicial Detection Inspectors, and they shall have the right to inter the custom area to inspect any means of transportation suspected of having carried an agricultural consignment.
The authorities of customs, ports, and any other authorities shall provide all facilities to those commissioners to carry out their profession.
Article (13)
The Minister of Agriculture and Fisheries shall issue the necessary decrees for the implementation of the provisions of this law as follows:
1- prohibition of exporting the plants and plant products that are not corresponding with the agricultural quarantine system of the imported countries.
2- Conditions of licensing for importing and exporting of plants, plant productions and cases of exceptions from licensing.
3- To identify the fees should be collected to implement the provisions of this law, the resolutions issued for the execution of this law and the conditions of exceptions.
Article (14)
This law shall be issued in the Official Gazette and it shall be implemented after three months from the date of to publication.
