Article (1)

In implementation of the provisions hereof, the following words and phrases shall have the meanings respectively assigned to them unless the context otherwise requires:
State: The United Arab Emirates.

Agency: The Federal Environmental Agency.

Certification Authorities: The authorities approved by the Ministry or any authority affiliated thereto that will attest the local and imported Organic Inputs and Organic Products.

Certified Organic Production: Production processes in conformity with the organic production conditions and standards certified by the approved Certification Authorities approved by the Ministry or any authorities affiliated thereto.

Circulation: The offer for sale, selling, storage or transportation through any transport mean.

Competent Authority: The authority competent to organize the production and Circulation of animal and agricultural Organic Products and Organic Inputs in each emirate.

Manufacturer: Any natural or corporate person producing, manufacturing, preparing or circulating the Organic Inputs and Organic Products.

Minister: The Minister of Environment and Water.

Organic Certification: The procedures taken as to the farms, factories or storages for obtaining a certified organic production to ensure that all production, manufacturing and Preparation processes are made in conformity with the approved standards.

Organic Inputs: The substances included in the regulations, which are permitted to be used as per the organic standards.

Organic Products: The substances defined in the regulations, which are produced, prepared and circulated in manners compatible with the Organic Production Standards and conditions.

Organic Production Standards: The conditions approved in the State that are relating to the production, Preparation, manufacture and Circulation of Organic Inputs and Organic Products.

Organic Production Units: Any packing, packaging or Preparation farm, factory or shop of Organic Inputs and Organic Products.

Preparation: The preservation or transformation processes of Organic Products, including the amendment, organization and labeling.

Article (2)

The provisions of this Law shall be applicable to each natural or corporate person producing, manufacturing, preparing, circulating, importing and exporting the Organic Products and Organic Inputs and shall further be applicable to the licensed Organic Production Units and the Certification Authorities.

Article (3)

The Ministry shall be competent to:
1. Setting the standards and specifications of the Organic Inputs and Organic Products;
2. Setting the conditions and procedures of inspecting and analyzing the Organic Inputs and Organic Products as well as assessing its viability and labeling;
3. Listing the substances permitted to be used as Organic Inputs within the organic production system;
4. Determining the requirements of the poster and card details related to the Organic Inputs and Organic Products;
5. Setting the import and export requirements of Organic Inputs and Organic Products;
6. Following up the procedures adopted by the Certification Authorities for the Organic Certification; and
7. Setting the registration conditions for the authorities operating in the Organic Certification.

Article (4)

Each natural or corporate person subjecting to the provisions hereof shall be bound by the specifications, controls, procedures and standards defined therein and in the executive regulations thereof.

Article (5)

The Manufacturer shall keep records for following up all matters relating to the Organic Production such as supplies, management and sales. The Manufacturer shall further notify the Competent Authority and the Certification Authorities of the organic activity program as per the mechanism defined in the executive regulations hereof as from the date of starting such activity and shall submit all information relating to his activity as needed.

Article (6)

The Organic Inputs and Organic Products, imported and exported, shall subject to inspection of the Competent Authority as prescribed in the executive regulations hereof. In case such Organic Inputs and Organic Products are included in the prohibited regulations, it may be used by a prior written permission from the Minister when necessary.

Article (7)

The executive regulations hereof shall specify the standards and requirements necessary for the organic production, botanical and animal, the registration and renewal procedures of the Organic Production Units. It shall further specify the procedures of inspecting the imported Organic Products and Organic Inputs and all relevant documents, certificates and data required and the manner of disposal of Organic Products and Organic Inputs incompatible with the articles and provisions hereof and all rules governing the use of the State's official organic production emblem.

Article (8)

The Minister may prohibit producing, manufacturing, exporting, importing or circulating any organic animal or agricultural Organic Product or Organic Input permanently or temporarily as the public benefit may require.

Article (9)

The employees appointed by a resolution of the Minister of Justice in agreement with the Minister shall have the capacity of judicial officers as to recording any breach of the provisions hereof, the regulations and decisions issued in implementation thereof within the spheres of their competence.

Article (10)

Without prejudice to any severer penalty provided for in any other law, a penalty of imprisonment for a period not more than six months and a fine not less than AED 20000 (twenty thousand Dirhams) but not more than AED 100.000 (one hundred thousand Dirhams) or either one of these penalties shall be imposed on any one who violates any provision hereof.

Article (11)

A regulation of the administrative measures shall be issued by a resolution of the Minister such as the license suspension, temporal and final closure inflicted on any person who violates or breaches any of the provisions of this Law and the executive regulations hereof.

Article (12)

The due fees shall be by a resolution of the Cabinet determined in accordance with the provisions hereof.

Article (13)

All those governed by the provisions hereof shall conciliate their positions according to the provisions and resolutions issued in implementation thereof within one hundred and eighty days from the date on this Law is effective.

Article (14)

The Minister shall issue the executive regulations and all resolutions necessary for the implementation of the provisions hereof.

Article (15)

Any provision inconsistent with or contrary to the provisions hereof shall be rendered null and void.

Article (16)

This Law shall be published in the Official Gazette and shall come into force from the day following the date of its issue.
